Agreement Overview

These Terms of Service ("Terms") govern your use of The Cyber Arm Security's managed cybersecurity services, website, and related offerings. By engaging our services or using our website, you agree to be bound by these Terms.

The Cyber Arm Security ("Company", "we", "us", "our") is a Canadian managed security service provider specializing in cybersecurity solutions for businesses across Canada.

Managed Security Services

  • Managed Detection and Response (MDR)
  • 24/7 Security Operations Center (SOC) monitoring
  • Security Information and Event Management (SIEM)
  • Incident response and forensic analysis
  • Vulnerability assessments and penetration testing
  • Compliance consulting and auditing
  • Security awareness training

Professional Services

  • Cybersecurity gap assessments
  • Security architecture design
  • Policy development and review
  • Risk assessments and management

Client Responsibilities

  • Provide accurate and complete information about your IT environment
  • Grant necessary access to systems and networks for service delivery
  • Maintain current contact information for emergency notifications
  • Implement recommended security measures in a timely manner
  • Report security incidents and concerns promptly
  • Ensure compliance with applicable laws and regulations
  • Make timely payments according to the agreed schedule
  • Provide feedback and participate in service reviews

Service Level Agreements

Response Times

  • Critical Security Incidents: Response within 15 minutes, 24/7/365
  • High Priority Issues: Response within 1 hour during business hours
  • Medium Priority Issues: Response within 4 hours during business hours
  • Low Priority Issues: Response within 24 hours during business hours

Service Availability

  • SOC monitoring: 99.9% uptime guarantee
  • Alert delivery: 99.5% success rate
  • Scheduled maintenance windows with advance notice

Payment Terms

  • Monthly or annual billing cycles available
  • Payment due within 30 days of invoice date
  • Late payments subject to 1.5% monthly interest charge
  • Service suspension possible for accounts 60+ days overdue
  • All prices in Canadian dollars unless otherwise specified
  • Price changes with 90 days advance written notice

Confidentiality and Data Protection

We maintain strict confidentiality regarding your business information, security posture, and incidents:

  • All client data treated as confidential and proprietary
  • Employee confidentiality agreements and security clearances
  • Data encryption and secure storage practices
  • Compliance with PIPEDA and applicable privacy laws
  • Regular security audits and certifications
  • Incident notification procedures per contractual agreements

Limitations of Liability

While we provide best-effort security services, cybersecurity risks cannot be completely eliminated:

  • Services provided on a reasonable commercial efforts basis
  • No guarantee of preventing all security incidents
  • Liability limited to the monthly service fees paid
  • Excludes consequential, indirect, or special damages
  • Client responsible for implementing recommended security measures
  • Insurance coverage recommended for comprehensive protection

Termination

Termination by Client

  • 30 days written notice required
  • No refunds for prepaid services
  • Data return or secure destruction as requested

Termination by Company

  • For cause: Immediate termination possible
  • For convenience: 30 days written notice
  • Unpaid invoices: 7 days notice after 60-day delinquency

Acceptable Use Policy

Our services must be used in accordance with applicable laws and ethical standards:

  • Compliance with Canadian federal and provincial laws
  • No illegal or malicious activities
  • Respect for intellectual property rights
  • No interference with service delivery to other clients
  • Cooperation with incident response activities

Governing Law

These Terms are governed by the laws of Ontario, Canada, and any disputes will be resolved through binding arbitration in Toronto, Ontario. Both parties agree to the jurisdiction of Ontario courts for enforcement of arbitration awards.
